Acceptance of Terms

Your access to or use of any emporiastudio service constitutes your agreement to abide by these Terms of Service together with all applicable federal, state, and local laws and regulations of the United States. Should you disagree with any portion of these terms, you may not use any emporiastudio offering. Any individual accessing the service on behalf of a company or other organization affirms that they hold the authority to bind that entity to these terms.

Use of the Website

You agree to use emporiastudio's services solely for lawful, personal, non-commercial purposes unless emporiastudio has granted you explicit written authorization otherwise. You must not:

• Contravene any applicable law or regulation, including consumer protection and product safety rules
• Send unsolicited advertising, promotional material, or spam through our platform
• Seek unauthorized entry to our systems, user accounts, or inventory databases
• Misrepresent yourself as any person or entity, including emporiastudio staff or other users
• Deploy automated tools, scrapers, or bots to harvest product pricing, inventory, or user data from our platform
• Submit fraudulent, excessive, or malicious orders, including orders placed without any intent to receive the goods
• Resell emporiastudio products for commercial profit without our express written consent

Product Information and Pricing

emporiastudio strives to keep product descriptions, pricing, specifications, and availability details accurate and current. Should an error arise in product information, pricing, or availability, emporiastudio may correct the error and cancel any orders placed on the basis of the incorrect information at no cost to you. For items with natural variability (such as handmade or natural material goods), minor differences in dimensions, weight, or appearance from the listed specifications may occur. Product information and warnings are supplied for reference only; emporiastudio cannot guarantee that products are free from cross-contamination during processing or packaging. Product availability may differ by delivery zone, pickup location, and selected time slot.

Orders and Payment

Every order is contingent upon product availability and acceptance by emporiastudio. emporiastudio may decline or cancel any order at its sole discretion, including orders that appear fraudulent, breach these terms, or cannot be fulfilled because of stock shortages. Full payment must be received before order dispatch or pickup, unless otherwise agreed in writing. Minimum order values and delivery fees may apply depending on your selected delivery zone and time slot. For age-restricted products (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age to purchase such items in your jurisdiction, and valid government-issued ID will be required at delivery or pickup. If an item in your order is out of stock, we will notify you before dispatch and may offer a suitable substitute, or issue a refund for the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All content on emporiastudio's platforms — including text, images, logos, software, private label product packaging, and the "emporiastudio" name and branding — is the exclusive property of emporiastudio and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any emporiastudio content without our express written permission. User-generated content (including product reviews, photos, and comments) submitted to our platforms may be used by emporiastudio for marketing, promotional, or operational purposes, subject to our Privacy Policy.

User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must notify emporiastudio immediately of any unauthorized use of your account or any other security breach. You are also responsible for providing accurate, up-to-date contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you submit are truthful and complete. If you place an order on behalf of a third party, you are solely responsible for ensuring that third party meets all legal eligibility requirements for purchased products, including age restrictions for restricted goods.

Limitation of Liability

To the fullest extent permitted by law, emporiastudio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including but not limited to damages for incidental loss or delivery delays. Our total aggregate liability to you for any claim arising from a single transaction shall not exceed the total amount you paid for the products or services in question. emporiastudio is not liable for failures or delays in service resulting from circumstances outside our reasonable control, including but not limited to supply chain disruptions, severe weather, public health emergencies, or third-party carrier delays.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of emporiastudio's services shall first be submitted to emporiastudio's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

emporiastudio may update, modify, or replace any part of these Terms at any time at its sole discretion. If we make material changes to these Terms, we will provide at least 30 days' advance notice via email to the address associated with your account, or via a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using emporiastudio's services prior to the effective date of the changes.
